The Zagreb County Court on Monday afternoon began closed-door deliberations on the verdict by a Hungarian court that has sentenced former Croatian Deputy Prime Minister Radimir Cacic to 22 months in prison for causing a fatal car accident in Hungary in 2010.
A panel of judges needs to align the Hungarian verdict with the Croatian legal system and deliver a new verdict based on the facts that were established at trial. The judges will not discuss Cacic's guilt or the facts, but only the sentence, which must be in accordance with Croatian legislation and case law and may not be more severe than the Hungarian verdict or replaced with a fine.
The Hungarian court sentenced Cacic to a year and nine months in prison. Half the sentence must be served in prison, while the other half may be converted into a suspended sentence.
Even if the judges reach a decision today, it will not be announced until it has been delivered to the parties who were not invited to today's session, court spokeswoman Ivana Calic said. She added that the court's decision would be made public on the court's website.
The panel's decision may be appealed with the Supreme Court and a final decision must be upheld by the Hungarian justice minister. If the Hungarian authorities are not pleased with the Croatian court decision, they may deny their permission for Cacic to serve his sentence in Croatia.
According to Croatian media reports, the Hungarian Ministry of Justice has set two conditions - Cacic must not be granted a pardon or amnesty and must serve his sentence in its entirety.
