The International Criminal Tribunal for the former Yugoslavia (ICTY) Prosecutor's Office believes that provisional release granted to General Slobodan Praljak should be quashed given that the ICTY Registrar announced that Praljak had to reimburse the tribunal for over EUR3 million in legal expenses, as an investigation had shown that Praljak had enough funds to pay for his defence on his own, the ICTY reported on Wednesday.
On August 22, the Registrar issued a decision indicating that although Praljak had declared himself indigent, he was in fact able to remunerate counsel in full as extensive investigations revealed he had significant assets.
The Trial Chamber's determination that Praljak's increased flight risk following the Registrar's decision could be neutralised by confining him to his residence was made without hearing the parties and is unreasonable, the prosecution said.
The prosecution also asked that Praljak be ordered to immediately return to the ICTY detention unit.
